Missouri City police, called to the scene of a car burglary in progress, nabbed three Houston men and recovered goods stolen in the break-in early Tuesday.

A resident in the 2600 block of Lakeside Village Drive called the Missouri City Police Department at 1:34 a.m. to report a vehicle burglary in progress in front of his home, according to police reports and a department spokesman.

Responding officers saw a vehicle speed off as they approached the area. They stopped the car and found three men inside.

Missouri City Police Capt. John Bailey said a "probably cause search" was conducted inside the car, and a gun was discovered in plain view in the open counsul between the car's passenger and driver seats.

Police also found "tools commonly used in burglaries," Bailey said - flashlights, latex gloves, screwdrivers and a window "punch."

Police also found an I-Pod, CD player and the wallet belonging to the victim who called police to report the burglary, Bailey said.

Arrested were Michael Eugene Caraway, 25; and brothers Daniel Sanchez, 20, and Juan Manuel Sanchez, 24.

All three men are from Houston, and all three were charged with burglary of a motor vehicle and organized criminal activity.

The Sanchez brothers also were charged with unlawful carrying of a weapon.

Caraway, whom Bailey said had been convicted of past crimes, was charged with unlawful possession of a firearm by a felon.

COWBOYBILL,

Nobody is chastising these officers. Adjust your glasses. However, it is your right as a citizen of this country, state, and county to voice your opinion here. God bless America! And no, speeding is not probable cause for a warrantless search. It is cause for them to be stopped, but as the article stated:

"Missouri City Police Capt. John Bailey said a "probabl[e] cause search" was conducted inside the car, and a gun was discovered in plain view in the open [consul]".

Seeing the gun before a search would be probable cause for a search. Notice it was never stated where the car was speeding, or if it was going 1 or 20 mph over the limit. Even going 20 mph over, with no smell or sight, or other sense of contraband is NOT probable cause. But what do I know. I'm an "ass", right?

So COWBOYBILL, do you "like" the boy from Simonton?

FBN does a great job in reporting and am " HUMBLE 2 B ALLOWED" 2 blog!

MC police can not B everywhere at the same time and when any "COP" sees a speeding car then I would hope they would give "CHASE"!!! Speeding is

I was just kidding about getting something expunged. I don't think I've ever broken the law, except for speeding, lol. I do love to hunt, though.

I do have to slow down in Simonton. Those cops probably would plant something on me just so they can have something better to do than listen to complaints from the "boys" of their city.

SimontonBoy,

It's called a blog. Check your First Amendment rights and get back to me. You say "professionals" but notice how I am always correcting grammar when I'm quoting an article. If you don't like it, then stop reading when you get to "related stories".

LMAO

Mega, I understand you're point of view and I agree with you. All I'm saying is it sounded like they were trying to over-justify actions and I sincerly hope these three don't get let go because of a technicality. Well, the felon around the gun is black and white...he's screwed. Oh wait, no he's screwed. Johnny Cockren is dead.

Probably couldn't see the gun from outside the car but once they stuck their heads in they could see the gun in the open console. That would be my guess.

Mega, I agree that a speeding car from a crime scene would create probable cause. But that being said, why did the captain say the gun was in plain view in a media statement? It sounds like they were trying to "double cover" themselves. To me, that sounds like something MCPD might be trying to hide. Where did the police start to see the car speed off? There are many questions on this one! Like I said, let's hope they did it by the books. These 3 sound guilty because of the items found. (I say sound because we are all innocent until proven guilty) I would hate to see 3 criminals have their charges dropped because of a technicality.
